Attorney Fred Herman in New Orleans, LA

Fred L. Herman obtained his undergraduate degree from Tulane University in 1972 and graduated from Loyola University School of Law in 1975. He began his career in practice with his father Harry Herman, and his brothers Russ Herman and Maury Herman, before establishing the Law Offices of Fred L. Herman in the spring of 1987. In September 2018, Fred joined the firm of Chehardy Sherman Williams.

Fred served with his brother Russ as regional litigation counsel for a major Life and Health Insurance company and with brother Maury as litigation and business counsel for the automobile dealerships and banking interests of Tom Benson.

He began to put his extensive and varied experience to work building the Fred L Herman Law Firm. He has been recognized by his peers and the Judiciary, including SUPER LAWYERS, BEST LAWYERS AND MARTINDALE HUBBEL for having the highest ethical standards and outstanding legal ability.

His litigation and appellate practices have taken him to almost every Parish and Judicial District in Louisiana and to Federal Courts in Louisiana, Mississippi, Texas, New York and Washington, D.C. Highlights of business practice include serving as Chief Negotiator to help Tom Benson acquire the New Orleans Saints, and was part of the original ownership group of the Saints put together by Mr. Benson. Thereafter, he represented Rob Couhig in the sale of his interest in the New Orleans Zephyrs, which later became the Baby Cakes, the city’s AAA minor league baseball team. Fred also handled all aspects of a regional highway safety and traffic control business for a New York Stock Exchange multi-national company. He had the pleasure of representing the Sewell Automotive Group and Carl Sewell’s New Orleans interests. 

During the last 30 years, the need for experienced counsel to address insurance coverage issues has led a number of prominent businesses to seek Fred’s advice and litigation skills where necessary to enforce policyholder rights in serious property damage and injury claims. Fred has taught and lectured at Loyola University School of Law Skills Curriculum and the Tulane School of Law Trial Advocacy seminar. With extensive experience in government administration, he has represented the City Council and the Office of Mayor for the City of New Orleans, the Orleans Parish Board of Assessors, the Orleans Parish District Attorney and the Clerk of Civil District Court for the Parish of Orleans. He is recognized for his consummate skills in crisis management, which served his clients well in the aftermath of Hurricane Katrina in 2005.

Following Hurricane Katrina, Fred was part of the litigation team that successfully litigated against the bad faith insurance practices of Louisiana Citizens Insurance, resulting in a Judgment and settlements in excess of $120 million. The case proceeded to the U.S. Supreme Court and is one of the largest recoveries in the history of bad faith insurance penalties.

Fred is also recognized for his extensive experience as a court-appointed Special Master and is an active Arbitrator and Mediator in civil disputes, including employment law, discrimination, construction claims, environmental and asbestos cases and all complex litigation, mass joinder and class action. He has been appointed independently and through the panels of the AMERICAN ARBITRATION ASSOCIATION (AAA) and AMERICAN HEALTHCARE LAWYERS ASSOCIATION (AHLA).  He is and is a member in good standing in the ACADEMY OF COURT APPOINTED SPECIAL MASTERS.

Fred is a member of The American Bar Association, The Louisiana Banker’s Association – Bank Lawyer’s section, the Federal Bar Association, and New Orleans and Jefferson Parish Bar Associations. Fred is also a member of the American Bar Association, American Association for Justice and its state counterpart, the Louisiana Association for Justice. Fred is a member in good standing and licensed by the Louisiana State Bar Association and is admitted to practice in all Louisiana State Courts, United States Federal Courts in Louisiana and the Supreme Court of the United States.
